Inako GmbH is the operator of the website http://www.okani.ch . Inako GmbH is therefore responsible for the collection, processing and use of your personal data and the compatibility of data processing with the applicable data protection law.

 

We take data protection seriously and pay attention to the security of your data. In doing so, we observe the statutory provisions of the Federal Law on Data Protection ("DSG"), the Ordinance on the Federal Law on Data Protection ("VDSG"), the Telecommunications Act ("FMG") and other applicable data protection provisions of Swiss or EU law, in particular the General Data Protection Regulation ("GDPR").

So that you know what personal data we collect from you and for what purposes we use it, please take note of the following information.

1. Data we collect when you access the website

When you visit our website, our servers temporarily save every access in a log file. As with every connection to a web server, the following technical data is recorded without your intervention and stored by us until it is automatically deleted: 

  • the IP address of the requesting computer;

  • the name of the owner of the IP address range (usually your Internet access provider);

  • the date and time of access;

  • the website from which the access was made (referrer URL), possibly with the search term used;

  • the name and URL of the file accessed;

  • the status code (e.g. error message);

  • the operating system of your computer;

  • the browser you are using (type, version and language);

  • the transmission protocol used (e.g. HTTP / 1.1); and

  • possibly your username from a registration / authentication.

 

The purpose of collecting and processing this data is to enable the use of our website (connection establishment), to ensure system security and stability over the long term and to enable the optimization of our website. This data can also be used for internal statistical purposes. The processing of this data is in our legitimate interest in order to continuously improve our website based on it.

The IP address is also evaluated together with the other data in the event of attacks on the network infrastructure or other unauthorized or improper website uses for clarification and defense and, if necessary, used in criminal proceedings for identification and for civil and criminal proceedings against the users concerned. We have a legitimate interest in such data processing in order to prevent unauthorized access in the future and to improve our system stability accordingly.

2. Data collected by us when shopping in the online shop

We would like to point out that we need the following data from you for the purpose of shopping in our online shop: 

  • First name, last name, e-mail address, home address (including postcode and city), country and your payment information

 

We only use this data and any additional information you voluntarily provide in order to be able to offer and deliver the goods to you in the best possible way. The processing of this data is therefore necessary for the implementation of pre-contractual and contractual measures. Without this data, we cannot conclude the contract with you.  

This data will not be transmitted to third parties, with the exception of the transmission of the credit card data to the bank / payment service provider to debit the purchase price, to the commissioned shipping company (Swiss Post) to deliver the goods and to our tax advisor to fulfill our tax obligations.

After cancelling the shopping process, the data stored by us will be deleted. In the event of a contract being concluded, all data from the contractual relationship will be stored until the expiry of the tax retention period (10 years). The data name, address, purchased goods and date of purchase are also stored until the product liability expires (10 years).

3. Use of your own cookies

Cookies help us to make your visit to our online shop easier and more pleasant. Cookies are information files that your web browser automatically saves on your computer's hard drive when you visit our website.

 

We use the following cookies in particular:

  • Technically necessary cookies;

  • Performance cookies;

  • Functional cookies;

  • Advertising cookies.

 

We use these cookies, for example, to temporarily save your selected services and entries when filling out a form on the website so that you do not have to repeat the entry when calling up another subpage.

4. Google Analytics

 

We use the web analysis service of Google Analytics for the needs-based design and continuous optimization of our website. Cookies are used in this context. The information generated by the cookies about the use of our online shop is transmitted to the server of the provider of these services, stored there and processed for us. In addition to the data listed under No. 1, we may receive the following information:

  • navigation path taken by a visitor on the website;

  • length of stay on the website or subpage;

  • the subpage on which the website is left;

  • the country, region or city from which access is made; 

  • end device (type, version, color depth, resolution, width and height of the browser window); and

  • returning or new visitor.

 

The information is used to evaluate the use of the website, to compile reports on website activity and to provide other services related to website and internet usage for the purposes of market research and the needs-based design of this website. This information may also be transferred to third parties if this is required by law or if third parties process this data on behalf of us.

Google Analytics is provided by Google Inc., a company of the Alphabet Inc. holding company, based in the USA. Before the data is transmitted to the provider, the IP address is generally shortened by activating IP anonymization ("anonymizeIP") on this website. The anonymized IP address transmitted by your browser as part of Google Analytics will not be merged with other Google data. The full IP address will only be sent to a Google server in the USA and shortened there in exceptional cases. According to Google Inc., under no circumstances will the IP address be associated with other data relating to the user.

5. Data storage by web hosting providers

Our URL is hosted on the Wix platform. Wix provides us with the online platform through which we can sell our products and services to you. Your data can be stored via the data storage, databases and general Wix applications from wix.com. Your data (including IP address, operating system, access time, browser type, browser request and origin of the request) are stored on secure servers. The data storage on your part is necessary for technical reasons so that you can use our online shop. The web hosting provider wix uses technical and organizational measures to protect this data from unauthorized access and does not pass it on to third parties.

 

Wix has servers all over the world including Europe and the United States. The data relating to you are systematically recorded and linked to process your orders and process the contractual services. We base the processing of this data on our legitimate interest in customer-friendly and efficient customer data management.

6. Duration of data storage

We only store personal data for as long as it is necessary to use the above processing within the scope of our legitimate interest. Contract data will be kept longer by us, as this is required by statutory retention requirements. Retention obligations that oblige us to retain data arise in particular from the provisions on accounting, civil law and tax law. According to these regulations, business communication, concluded contracts and accounting documents must be kept for up to 10 years.

7. Transfer of data to third parties

We only pass on your personal data to other third parties if you have given your express consent, if there is a legal obligation to do so or if this is necessary to enforce our rights, in particular to enforce claims from the contractual relationship. In addition, we pass on your data to third parties, insofar as this is necessary in the context of the use of the website and the execution of the contract (also outside the website), namely the processing of your orders.

8. Right to information, correction, deletion and restriction of processing as well as data portability

You have the right to request information about the personal data that we store about you. In addition, you have the right to correct inaccurate data and the right to delete your personal data, as long as there is no statutory retention obligation or a permit that allows us to process the data.

You also have the right to request that we return the data that you have given us (right to data portability). On request, we will also pass the data on to a third party of your choice. You have the right to receive the data in a common file format.

9. Application of law and place of jurisdiction

This data protection declaration and the contracts that are concluded based on or in connection with this data protection declaration are subject to Swiss law, unless the law of another country is mandatory.  

The place of jurisdiction is Zurich, unless another place of jurisdiction is mandatory.
